Our Terms & Conditions

1) These terms and conditions apply to anyone who uses any product, service, or resource provided by KyAnn Wellbeing.

 

All rights are reserved to KyAnn Wellbeing.

 

Terms:

‘you’- the user, account holder, customer, client

‘we’, ‘us’- KyAnn Wellbeing

 

2) Disclaimer

 

a) All products, services and resources provided by KyAnn Wellbeing are to be used at the users’ own discretion.

 

b) It is the responsibility of the user to determine whether the products, services and/or resources are appropriate for use, this includes considering the age of the maturity, level of understanding, and the health and wellbeing of the individual using the products, services, and/or resources. KyAnn Wellbeing is not responsible for this and will not be held accountable for how the product, service and/or resource is used.

 

c) Our products, services, and resources should not replace professional medical advice or treatment. It is the user’s responsibility to consult a doctor or mental health professional if they have any questions or concerns regarding their health and wellbeing and/or that of anyone else in their care or supervision.

 

d) Products, services, or resources provided by KyAnn Wellbeing are not suitable for those aged under 3 years.

 

e) When using our products, services and/or resources, the user agrees that they are responsible for providing those who are vulnerable and/or are under the age of 18 years, with appropriate adult supervision at all times whilst using our products, services and/or resources.

 

f) KyAnn Wellbeing is not responsible for, nor will they be held accountable for, any injury, harm, or mishap that may occur when using any of our products, services and/or resources.

 

3) Access to Free Resources

 

a) KyAnn Wellbeing provides a number of free resources on their website. Users are not required to sign up to the membership hub to view, download, and print these resources. However, by accessing these resources, the user is agreeing to the terms and conditions of usage outlined in sections 2 and 8.

 

b) KyAnn Wellbeing has the right to change, adapt, and/or remove these free resources at any point, without warning.

 

4) Purchases and Delivery of Products, Services, and Resources

 

a) At KyAnn Wellbeing we aim to provide all digital product orders within 48 hours via email. If you do not receive an email within 48 hours, please contact us at info@kyannwellbeing.co.uk

 

b) We aim to dispatch all physical orders within 48 hours.

 

Delivery cost:

 

Digital purchases- Free of charge

 

Physical purchases- £3.95/Free of charge for orders over £50

 

c) For purchases requiring the downloading of our digital products, services, or resources, if you wish to download these within 14 days of receipt of your order, you will be required to waive the 14-day cooling-off period. This is necessary as when products, services, and/or resources are downloaded to your device, we are then unable to secure a return. By accepting our terms and conditions you agree to waive the 14-day cooling-off period. However, if you do not give your consent, please contact us at info@kyannwellbeing.co.uk for further advice and assistance, as you can still make the purchase, however, without consent, you will not be able to download our digital products, services, and/or resources until the 14-day cooling-off period has ended. Once this period has ended, you will receive your purchase via email.

 

5) Refunds and Cancellations of Products, Services, and Resources

 

a) You can cancel your order at any time, up until your order has been dispatched. If you no longer require your order at this point, you will need to request a refund.

 

b) Full-priced products, services, and resources are covered by a 14-day cooling-off period. This means that you are entitled to a full refund upon return of full-priced products, services, and resources, up until and including the day your order was delivered.

 

c) As outlined in section 4c, for purchases requiring the downloading of our digital products, services, or resources, by accepting our terms and conditions you agree to waive the 14-day cooling-off period. However, if you do not give your consent, you will need to wait to download our digital products, services, and/or resources once the 14-day cooling-off period has ended; you will have the right to a full refund if your order is cancelled without this time frame.

 

d) Sale items are non-refundable but can be exchanged when damaged or defective

 

6) Use of the Subscription Membership Hub

 

a) By the term ‘account holder’ we are referring to the person who has signed up as a member of the KyAnn Wellbeing Membership Hub.

 

b) To sign up as an account holder of the KyAnn Wellbeing Membership Hub the user must be over 18 years of age and agree to the terms and conditions of usage.

 

c) At KyAnn Wellbeing we aim to provide access to the membership hub subscription within 48 hours via email. If you do not receive an email within 48 hours, please contact us at info@kyannwellbeing.co.uk

 

d) Subscription fees are payable either monthly or yearly and will be taken via Wix payments.

 

e) It is the account holder’s responsibility to ensure that all the information supplied to KyAnn Wellbeing is true, accurate, up-to-date, complete, and not misleading or meant to cause harm to KyAnn Wellbeing, any of their subscription members, customers or clients, or the wider population.

 

f) As an account holder, you may view, download and/or print our digital resources from our website for personal (use within your home) and professional work (use with clients). All resources provided by KyAnn Wellbeing are to be solely used by the account holder, meaning that they must not be sold or distributed to any other third party. The account holder may adapt the resources to suit the needs of the individual, but all adaptions must reference KyAnn Wellbeing as the creator and owner of the material.

 

7) Refunds and Cancellation to the Subscription Membership Hub

 

a) A subscription membership can be cancelled at any time, however, a refund will not be given if the account holder is already within their chargeable time frame. Those who have paid a yearly membership subscription are not entitled to a refund for that year paid if the subscription is cancelled prior to their year subscription being renewed. However, in such cases, they will not be charged the following year’s subscription fee. The only exception to this is in cases where cancellations are made during the 14-day cooling-off period, in which case, a refund will be issued should cancellations occur during this time.

 

b) No refunds will be offered on occasions when KyAnn Wellbeing needs to pause account usage temporarily, due to the management of its website.

 

8) Additional Information

 

a) KyAnn Wellbeing promotes a culture of kindness, compassion, and acceptance. Hatred, bias, or discrimination of any form will not be tolerated, nor will false and/or misleading information meant to cause harm to KyAnn Wellbeing, any of their subscription members, customers, clients, or to the wider population.

 

b) Any breaches to the terms and conditions will result in the termination of the account holder’s subscription membership, and/or refusal of future products, services, and or resources provided by KyAnn Wellbeing. KyAnn Wellbeing has the right to withdraw/refuse orders and services at any time, without explanation.

 

c) In cases where breaches in the subscription service have taken place, resulting in the termination or refusal of membership, refunds will not be given for the remaining time frame prior to the next payment being due, however, in these cases, the next payment, whether it be monthly or yearly, will not be taken.

 

d) In cases where breaches of any other form have taken place, KyAnn Wellbeing reserves the right to cancel orders. In such cases refunds will be issued for products and services not yet dispatched.

 

e) Breaches do not affect your right to a refund when requested within the 14-day cooling-off period.
